2.1 Service Overview:

• Nexdha offers two primary services:
  a. Bill Payment Solutions: Seamless utility bill payments, mobile recharges, FASTag recharges, and more through MachPay.
  b. Online Learning: High-quality courses across skill development, certification, and academics through LearnAcadme.

2.2 Service Modifications:

• Nexdha reserves the right to update, modify, or discontinue any of its services without prior notice. Such changes may include new features, removing old services, or introducing additional charges.

2.3 No Warranty:

• While we strive to maintain uninterrupted access, Nexdha does not guarantee that our services will be error-free or always available. Service interruptions may occur due to maintenance, technical issues, or other factors beyond our control.
   

3. Payments

3.1 Payment Security:

• All transactions made on Nexdha are processed using PCI DSS-compliant systems, ensuring the highest levels of security for your payment information.

3.2 Transaction Failure:

• Nexdha is not responsible for failed transactions caused by:
  a. Incorrect or incomplete payment details provided by the user.
  b. Technical errors or disruptions on third-party payment gateways.
  c. Insufficient funds or issues with the user’s bank account or card.

3.3 Refund Policy:

• Refunds for failed or duplicate transactions, if applicable, will be processed in accordance with Nexdha’s Refund Policy. Users must report issues promptly to initiate a refund request.
   

4. Intellectual Property

4.1 Ownership:

• All content on Nexdha.com, including but not limited to text, graphics, logos, trademarks, icons, images, videos, software, and platform features, is owned by Nexdha AI Fintech Pvt Ltd and is protected under intellectual property laws.

4.2 Restrictions on Use:

• Users are prohibited from:
  a. Copying, reproducing, or distributing any content from the platform without explicit permission from Nexdha.
  b. Using Nexdha’s content or trademarks for commercial purposes.
  c. Modifying or reverse-engineering any part of Nexdha’s website or services.

4.3 Violation:

• Unauthorized use of Nexdha’s intellectual property may result in legal action, including claims for damages and/or an injunction.
   

5. Limitation of Liability

5.1 General Limitation:

• Nexdha and its affiliates, employees, or partners shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:
  a. Loss of data or revenue.
  b. Delays, service interruptions, or errors.
  c. Issues arising from third-party service providers, including payment gateways.

5.2 Force Majeure:

• Nexdha shall not be held responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, strikes, technical failures, or government actions.

5.3 User Responsibility:

• Users are responsible for their actions while using Nexdha’s platform and must comply with applicable laws and regulations.
   

6. Governing Law and Jurisdiction

6.1 Applicable Law:

• These terms and conditions shall be governed by and construed in accordance with the laws of India.

6.2 Dispute Resolution:

• Any disputes arising out of or related to the use of Nexdha’s platform shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu.
